Smoke and carbon monoxide alarms

A landlord in England must fit a smoke alarm on every storey with living space and a carbon monoxide alarm in any room with a fixed combustion appliance, except a gas cooker.

In short: The Smoke and Carbon Monoxide Alarm (England) Regulations 2015, as amended in 2022, require at least one smoke alarm on each storey used as living accommodation and a carbon monoxide alarm in every room with a fixed combustion appliance other than a gas cooker. Alarms must work on the first day of each new tenancy.

The landlord's duties:

  • Smoke alarms: at least one on every storey with a room used wholly or partly as living accommodation (a bathroom or toilet counts).
  • Carbon monoxide alarms: in every room used as living accommodation with a fixed combustion appliance, such as a gas boiler, oil boiler or wood burner. Gas cookers are excluded.
  • Check they work on the first day of each new tenancy, and record it.
  • Repair or replace an alarm once told it is faulty.

Councils can serve a remedial notice and fine a landlord up to £5,000 for not complying.
